Today the 11th of January, 2018,marks exactly 6 days since the Ambazonia interim leader: Sisiku Ayuk Tabe and his cohorts were arrested by DSS (a Nigerian secret security service) in a hotel in Abuja, Nigeria. Since then, neither the Nigeria or Cameroon government has made an official statement about the arrest or the fate of Sisiku Ayuk Tabe and his cohorts. This silence has generated lots of rumor on the social media (with so many amateur Cameroonian bloggers or activists speculating about their fate to satisfy the curiosity of the Ambazonians; who have been very worried since their leaders awere arrested ).

Due to the above facts, we had to consult a legal practioner in Nigeria to see if he could make sense of this "SILENCE" which has given birth to thousands of Rumors.


The legal practitioner told us that the government of Nigeria maybe conducting a private investigation to determine if there,s any collusion between Sisiku AyukTabe and co, with the outlawed Nigeria secessionist group Known as Biafra (which has also caused instability in the Eastern Region of Nigeria ). The legal practioner drew our attention to the fact that prior to the arrest of Sisiku AyukTabe and co, there has been a wide spread rumor that the Ambazonia defense forces had form an alliance with the Indigenous People of Biafra (IPOB) and to worsen the matter, the Ambazonia leaders were arrested following a lead provided by 39 ADF fighters who were earlier arrested in a training camp in Taraba state, North East, Nigeria.


 According to the Legal practitioner, now that Sisiku Ayuk Tabe and other high profile members of the Ambazonian movement have been arrested, this is the best time for the Nigerian government to get credible info and also get a clear picture of the activities of Sisiku AyukTabe and his cohorts in the Country. The legal practitioner added that until the Nigerian government has completed its investigations,they can,t release a statement regarding the arrest of Sisiku Ayuk Tabe and his cohorts. Any statement released prior to the completion of their investigation may likely pervert the course of their investigations leading to a prolongation of the investigation.The legal mind also revealed that according to the Nigeria constitution, investigators are given a particular time frame to conduct their investigation on a suspect. If they cannot find any incriminating info within the specified time frame, they are bound to release the suspect unconditionally.

Section 35(4) of the 1999 constitution of Nigeria states that any person who is arrested or detained for the purpose of bringing him before a court in execution of the order of a court or upon reasonable suspicions of his having committed a criminal offence, or to such extent as may be reasonably necessary to prevent him committing a criminal offence, shall be brought before a court of law within a reasonable time i.e. within 48hours; and if not tried within a period of two months from the date of arrest or detention, in case of a person who is in custody or is not entitled to bail, or three months, from the date of his arrest or detention. In case of a person who has been released on bail, he shall without prejudice to any further proceedings that may be brought against him be released either unconditionally or upon such conditions as are reasonably necessary to ensure that he appears for trial at a later date.

So the maximization of time is highly important when it comes to investigating a complex case like the collusion between Sisiku AyukTabe and the Biafrans. Nevertheless he assured us that very soon, the Nigeria government will release a communique about the arrest of Sisiku Ayuk Tabe and co because 48hours or the minimum timeframe for the Nigerian government to commence the trial of Sisiku AyukTabe and his cohorts has exceeded by 6 days. He also cited the Administration of Criminal Justice Act, 2015, (ACJA), particularly sections 293-299, which made it possible for magistrates to hold charge as a possible reason why the trial of Sisiku AyukTabe and co hasn,t began.


When questioned about the fate of the Ambazonia leaders, the reliable legal practitioner said if there is any collusion between Sisiku Ayuk Tabe and the Biafrans, they will stand trial in Nigeria and sent to jail if found guilty. But if they were arrested in honor of an international arrest warrant issued by the Cameroon government, they maybe extradited. However the legal practitioner revealed that currently (i.e. as of the date of this publication ) there,s no extradition treaty between Cameroon and Nigeria that would permit the Nigerian government to extradite Sisiku Ayuk Tabe and his cohorts to Cameroon. Nevertheless the legal practitioner clearly stated that extradition treaties are always signed when need be. Now that secessionists from the two countries have escaped to each other's territory, the two countries may be forced to sign an extradition treaty to facilitate the persecution of secessionists who have caused instability in both territories. The legal expert concluded by saying that we shouldn,t be surprised if an extradition treaty is signed between Cameroon and Nigeria in the days ahead.He reiterated that the Nigeria government still has up 2 months to commence the trail of Sisiku AyukTabe and his cohorts or else they will be released unconditionally. 2 months is more than enough time for both parties to sign an extradition treaty.
